Terms of Service
These Terms of Service ("Terms") govern your use of KhomaAPI (the "Service"), operated by KhomaAlgorithms LLC ("KhomaAlgorithms", "we", "us", "our"). KhomaAPI is a product of KhomaAlgorithms LLC. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
KhomaAPI is a cloud software platform that connects trading signals from third-party charting tools (such as TradingView) to your connected brokerage accounts, and enforces risk parameters you configure. KhomaAPI is a software tool only — it is not a broker, exchange, financial adviser, or money manager, and it does not provide trading or investment advice. See our Risk Disclosure.
2. Eligibility
You must be at least 18 years old and legally able to enter into contracts and to trade the relevant instruments in your jurisdiction. You are responsible for ensuring your use of the Service is lawful where you live.
3. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. Notify us immediately of any unauthorized use.
4. Broker connections
You connect your brokerage accounts through the broker's secure OAuth login flow. KhomaAPI accesses Tradovate through Tradovate's official API under Tradovate's API license terms. KhomaAPI does not receive your broker password and does not custody your funds. You authorize KhomaAPI to place and manage orders on your connected accounts according to the signals and risk settings you configure. You may disconnect accounts or pause automation at any time. Tradovate and any other supported broker or prop firm are independent third parties; they do not endorse, guarantee, or assume responsibility for KhomaAPI, and we are not responsible for their services, availability, or policies.
5. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or market abuse.
- Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service.
- Resell or sublicense the Service except under a written agreement (e.g., our Enterprise plan).
- Misrepresent the Service or violate the rules of your broker or prop firm.
6. Subscriptions, billing, and cancellation
Paid plans are offered on a subscription basis (monthly or annual) and processed by our third-party payment provider (Whop). By subscribing you authorize recurring charges until you cancel. You may cancel at any time; cancellation stops future renewals and your access continues until the end of the current billing period. All fees are non-refundable except where required by law. We may change pricing with notice; changes do not affect your current paid period. See our Refund Policy for full details.
7. No warranties; no guarantee of results
The Service is provided "as is" and "as available". We do not warrant uninterrupted, timely, secure, or error-free operation, and we do not guarantee any trading outcome, prop-firm compliance, or that risk controls will prevent losses. Automated systems and third-party dependencies can fail.
8. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us in the three (3) months before the claim. We are not liable for trading losses, lost profits, missed trades, account breaches, or indirect, incidental, special, or consequential damages.
9. Indemnification
You agree to indemnify and hold harmless KhomaAlgorithms from claims arising out of your use of the Service, your trading activity, or your breach of these Terms.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to you, others, or us.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. The parties agree to resolve disputes by binding arbitration on an individual basis in Florida, and you waive any right to participate in a class action, except where prohibited by law. Where arbitration does not apply, the state and federal courts located in Florida have exclusive jurisdiction.
