1. KhomaAPI is software, not a broker or advisor

KhomaAPI, a product of KhomaAlgorithms LLC ("the Service"), is a software tool that routes your trading signals to your connected brokerage account and enforces risk parameters that you configure. KhomaAPI is not a broker-dealer, futures commission merchant, investment adviser, or financial planner. We do not provide trading signals, investment advice, or recommendations of any kind. We do not manage your account or make trading decisions for you. KhomaAPI accesses Tradovate through Tradovate's official API under Tradovate's API license terms; Tradovate and any other broker or proprietary trading firm are independent third parties and do not endorse, guarantee, or assume responsibility for KhomaAPI.

2. Substantial risk of loss

Trading futures, options, and other leveraged instruments involves substantial risk and is not suitable for every investor. You may lose some or all of your capital, and in some cases more than your initial deposit. You should only trade with capital you can afford to lose. Past performance — yours, a strategy's, or anyone else's — is not indicative of future results.

3. You remain responsible for your accounts

KhomaAPI enforces the limits you set, but you should always monitor your own accounts and never rely solely on automated controls.

4. No guarantee of prop-firm compliance

KhomaAPI offers tools and presets to help you enforce risk rules, including templates that approximate common proprietary trading firm requirements. These presets are starting points only. Prop-firm rules are set by each firm and can change at any time without notice. KhomaAPI does not guarantee that using the Service will keep you compliant with any firm's rules or prevent a rule breach. You must verify all parameters against your firm's current, official rules.

5. Automated systems can fail

Automated trading and risk systems depend on third parties (your broker, data providers, internet and cloud infrastructure) and can experience delays, outages, errors, or failures outside our control. Orders may be delayed, rejected, partially filled, or not executed. A kill-switch or risk control may not act in time during fast markets, gaps, illiquidity, or connectivity loss. You accept these risks when using automated execution.

6. No warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant that the Service will be error-free or that any risk control will prevent losses.

7. Limitation of liability

To the maximum extent permitted by law, KhomaAlgorithms and KhomaAPI are not liable for any trading losses, lost profits, missed trades, account breaches, or any indirect, incidental, special, or consequential damages arising from your use of the Service. Your use of the Service is at your own risk.

8. Hypothetical and simulated performance

Any demo, simulated, or backtested results have inherent limitations and do not represent actual trading. Simulated performance does not account for real-world factors such as slippage, liquidity, and execution timing, and should not be relied upon as indicative of future results.
